In July 2024, the Watertown Police Department issued notices to local vape and smoke shops regarding upcoming changes to state law making certain THC and Delta products illegal to sell.

On May 28, 2025, the Watertown Police Department conducted compliance checks at eight vape and smoke shops in Watertown to ensure businesses were not selling legal THC products to individuals under 21. According to WPD, the following businesses passed the compliance checks:

  • America’s Smoke
  • Dakota Dispensary
  • Dakota Tobacco Co
  • Midtown Smoke
  • Smoke Solutions
  • Tobacco and Vape
  • Vape Depot

One business, Smokes R Us, sold Delta 8 gummies to an underage buyer, the release states. The employee was issued a citation for selling to an individual under 21.

Following these checks and in response to additional complaints regarding illegal product sales, the Watertown Police Department and the Codington County Sheriff’s Office executed two search warrants at vape/smoke shops in southeast Watertown on June 4, 2025. Over 2,000 illegal items were seized, WPD stated in a release.

Illegal prescription medication was also seized during the service of the warrants. This remains an active investigation, and additional charges are pending.

Under South Dakota law, the following products are illegal to sell: Delta 8, Delta 10, THCP, THCO and HHC. The WPD aims to prevent illegal sales of these substances in the community.

While some products can legally be sold to individuals age 21 and older, similar to alcohol, compliance with state law is mandatory. WPD will continue to monitor these businesses.
