New regulations on vape products in Alabama now in effect


MONTGOMERY, Ala. (WSFA) – New regulations on vape products in Alabama are now in effect.

House Bill 8 establishes stricter requirements for the sale of e-cigarettes and other alternative nicotine products.

Rep. Barbara Drummond (D-Mobile), the bill’s sponsor, said in May that the law aims to prevent Alabama’s youth from using and purchasing vape products.

“From the classrooms to in the community, we saw this becoming an epidemic,” she said.

HB8 requires vaping products sold in Alabama to be manufactured in the United States, and convenience stores can only sell the 34 tobacco and menthol-flavored e-cigarette products approved by the Food and Drug Administration. All other products have to be sold and purchased in stores for those 21 years old and up.

According to the law, the State Board of Education must establish a model vaping awareness, education, and prevention program and require each local board of education to adopt a policy based on that model.

The Alabama Alcoholic Beverage Control Board says the law “designates two specific retail permit types available to businesses.”

The board’s tobacco permit authorizes the sale of tobacco, tobacco products, non-vapor based alternative nicotine, e-liquids, electronic nicotine delivery systems, and vapor-based alternative nicotine products that have received an FDA marketing order.

The board also issues a specialty retailer of electronic nicotine delivery system permit, which allows stores to sell “any allowable e-liquids, electronic nicotine delivery systems, and vapor-based alternative nicotine products that meet the requirements of state and federal law.” Retailers with this license are those that can only sell to ages 21 and up, and they are required to have signs posted to indicate the age restriction.

The law went into effect June 1, 2025.
